MisiBi Terms and Rules of Use

This is the agreement between you and Bucovina Mission Organization about using the MisiBi app. By creating an account you accept these rules. If you do not agree with them, please do not use the app.

We have written it in words you can read without a lawyer. That does not make it any less binding.

This is a translation of the Romanian original. If the two ever disagree, the Romanian text is the one that applies.

1. What MisiBi is

MisiBi is a network of Bucovina Mission Organization, made so that volunteers, the people they help and those who want to help can find one another and talk.

It is offered free of charge and as it is — that is, with whatever works in it at any given moment. It is not a commercial service and we are not selling you anything.

2. Your account

• You must be at least 16, or have the agreement of a parent or guardian.
• The details you give when signing up must be real. An account impersonating somebody else or our association is closed.
• You are responsible for what happens on your account. Do not lend it out.
• We recommend turning on two-step verification in your account settings.
• You can close your account at any time, from the app.

3. What you may not do

You may not publish, send or upload:

Sexual content

MisiBi is the community space of a Christian mission, open to families and to children. Nothing of a sexual nature is published here — neither explicit nor suggestive, whoever it concerns and in whatever context.

• pornography, in any form;
• nudity and partial nudity, including the "artistic" or "educational" kind;
• descriptions, images, films, drawings or sounds that are sexually explicit;
• sexual innuendo, jokes with a sexual point, lewd language;
• clothing or poses meant to draw attention to the body in a sexual way;
• sexual solicitations, unwanted advances, messages to that end;
• links to sites, channels or accounts carrying such content;
• any sexual content involving a minor, in any form, including suggestion or solicitation.

This rule concerns the act, not the person: it applies equally to everyone, whoever is publishing.

Violence and hate

• threats against anybody, incitement to violence, graphic violent content;
• hate speech on grounds of ethnicity, religion, orientation, disability or nationality;
• harassment, persistent following, insistence after a clear refusal.

Things forbidden by law

• selling or offering weapons, ammunition or explosives;
• selling or offering drugs and prohibited substances;
• scams, phishing, pyramid schemes, "investments" that do not exist;
• promotion of gambling.

Other people's

• somebody else's personal data — address, phone number, national ID number — without their agreement;
• photographs of identifiable children without their parents' agreement;
• content that is not yours and that you hold no rights to;
• cruelty to animals.

Noise

• spam, unsolicited advertising, the same message sent in bulk;
• automated accounts that post by themselves;
• dangerous misinformation, especially false medical advice.

Speech

Write here as you would speak in a house where there are both children and elders.

• swearing and vulgar language, however much "in jest";
• curses, imprecations, wishing harm on anybody;
• mockery of God's name, of anybody's faith, or of holy things;
• insulting nicknames, humiliating irony, making a fool of somebody;
• bad jokes — at the expense of death, illness, misfortune, suffering, or another's trouble;
• quarrels carried on in public so as to be seen;
• anything you would do in a church full of children and feel bad about afterwards.

Political noise and strife

• political campaigning, calls to vote, attacks on public figures;
• stirring up quarrels between people, factions and division.

4. How we keep the rules

4.1. The automatic check

Every post, comment, story, message and file goes through an automatic check. The details are in the Privacy Policy, section 4.

Depending on how serious it is, content may be published, published with a warning, sent for review, hidden until a person looks at it, or refused. When it is refused, we tell you why.

4.2. Reports

Anybody can report anything: a post, a comment, a story, a message, a conversation, a profile, a file or a call.

A report is confidential — the person reported does not learn who reported them. When several people report the same thing, it is hidden automatically until a person looks at it.

False reports, made out of spite, are counted. Somebody who reports things that turn out to be real gains weight; somebody who reports anything at all loses it, and their reports go into a separate queue.

4.3. What we may do

MisiBi reserves the right to remove entirely, or to suspend, any post, photograph, short film (reel), story, comment, message or file that breaks the rules in section 3 or the safety rules in the Privacy Policy — without this implying that we have examined everything published, and without our silence on any one item amounting to approval of it.

More plainly, we reserve the right, at our reasonable discretion and without prior notice where the situation calls for it, to:

• delete or hide any content that breaks these rules;
• warn a user;
• temporarily suspend an account;
• permanently close an account, in case of a serious or repeated breach;
• limit certain features for an account (messages, uploads, calls);
• keep as evidence the content of a serious breach, even if its author has deleted it, and hand it to the authorities.

An account is never closed automatically by a machine. A person decides that.

4.4. Your right to appeal

If you disagree with a decision — content stopped, account suspended or closed — you can appeal, from the app. The appeal reaches a person, not another machine, and you get an answer.

An appeal does not suspend the decision while it is being considered, except where the mistake is obvious.

5. What you publish stays yours

The content you publish belongs to you. We do not claim it and we do not sell it to anybody.

You do give us permission, free of charge and limited, to store, display and transmit it within the app, as far as is necessary for the app to work — to appear in other people's feeds, to be saved, to be resized so it loads faster. This permission ends when you delete the content, except for technical copies that are removed in the ordinary cleanup cycle and for messages already received by somebody else.

You also give us permission to use public content in the association's materials (the Facebook page, the website, activity reports) only if you give us explicit agreement for each such use.

6. Other people's content

MisiBi hosts what people write. We do not review every post in advance, by a person, and we do not take on the content published by users.

We are not answerable for:

• the truth, quality or lawfulness of what somebody else writes;
• the arrangements you make with other users;
• damage arising from trusting a piece of information found here.

When we learn of illegal content, we act promptly to take it down.

If you see something illegal or dangerous, report it. The button is on everything.

7. Help between people

MisiBi puts people in touch, but it does not guarantee and does not check anything they promise one another.

If you ask for help or offer help through the app:

• check for yourself who you are talking to before giving money or goods;
• never send money to somebody you do not know because they wrote you a moving message;
• donations to the association are made only through the official channels on misiuneabucovina.org, never to a personal account received in a message;
• the association will never ask you, in a private message, for your password, for a code received by SMS, or for money into a personal account.

We are not answerable for losses suffered as a result of a direct arrangement between two users.

8. Availability

We do everything we can to keep the app running, but:

• it is offered free of charge and as it is, with no guarantee of uninterrupted, error-free operation or of fitness for any particular purpose;
• it may be unavailable for maintenance, for updates, or because of external providers;
• we may change, limit or switch off features, with prior notice where possible;
• we may shut the app down for good, giving at least 30 days' notice and offering the chance to download your data.

9. Our liability

To the extent permitted by law:

• we are not liable for indirect losses, loss of data resulting from misuse of the app, or loss of opportunity;
• our total liability, in any situation, cannot exceed the direct and proven damage, bearing in mind that the service is offered free of charge;
• nothing in these rules limits liability for personal injury, death, wilful misconduct or gross negligence, nor the rights the law gives you as a natural person which you cannot waive.

If you have suffered damage using MisiBi, write to us. We are an association of people, not a corporation — we will try to repair what can be repaired.

10. If you cause us damage

If you break these rules and, because of that, the association suffers damage or is called to answer to somebody — a complaint, a fine, a lawsuit — you undertake to compensate us for the direct and proven costs, within the limits permitted by law and in proportion to your fault.

We will not use this provision against somebody who made a careless mistake, reported something in good faith that turned out to be false, or told us about a security problem.

11. Copyright

The MisiBi and Misiunea Bucovina names, logo and materials belong to the association. Do not use them in a way that makes it look as though you are speaking on our behalf.

If you believe content on MisiBi infringes your copyright, write to us at contact@misibi.com with: what content, where it is, why it belongs to you, and your contact details. We check and act promptly.

12. What happens when you leave

You can close your account at any time, from the app.

When you do:

• your profile, posts and stories are no longer visible;
• messages sent to somebody else remain with the person who received them, just like a letter already posted;
• data is deleted within 30 days at the latest, with the exceptions in section 12.1 of the Privacy Policy;
• if we both change our minds, a closed account cannot be recovered after that deadline.

We may close an account, with notice and a reason, if it seriously or repeatedly breaks these rules, or immediately and without notice if the situation puts somebody in danger.

13. Governing law

These rules are governed by Romanian law. Disputes are settled by the competent courts in Romania.

If you are a consumer, you keep all the rights the law gives you and that you cannot waive by contract, whatever is written here.

We try first to settle any disagreement by talking. Write to us.

14. Changes

When we change something important, we tell you in the app at least 15 days beforehand. If you do not agree with the new rules, you can close your account — continuing to use the app after they come into force means you accept them.
